This Terms of Service Agreement (“Agreement”) constitutes a legally binding contract between MPY TOURS, SRL (“MPY TOURS,” “we,” “us,” or “our”) and the user (“Client,” “you,” or “your”) accessing our website, booking platforms, and utilizing our intermediary travel services.

By accessing this Website, registering an account, making any deposit, partial or full payment, or completing a reservation, you expressly acknowledge that you have read, understood, and agreed to be legally bound by this Agreement and our integrated Cancellation, Refund & No-Show Policies.

  1. Legal Capacity and Website Use

As a condition of your use of this Website, you warrant that:

  • All information supplied by you on this Website is true, accurate, current, and complete.
  • You are of legal age (18 years or older) to possess the legal authority to enter into this Agreement and use this Website in accordance with all terms herein.
  • You will safeguard your account information, supervise its use, and assume full financial and legal responsibility for any activity conducted under your account credentials.
  • You will only use this Website to make legitimate reservations for yourself or for third parties for whom you are legally authorized to act. Speculative, false, or fraudulent reservations are strictly prohibited.
  1. Payment Terms, PayPal Processing & Dynamic Currency
  • Accepted Payment Methods: All bookings and transactions must be settled in United States Dollars ($USD). We accept payments via PayPal accounts and Credit/Debit Cards processed through the PayPal secure platform.
  • Third-Party Processing: MPY TOURS does not store credit card numbers, debit card numbers, or sensitive financial data on its servers. Financial transactions are securely redirected and processed entirely by PayPal, which complies with global PCI-DSS encryption standards.
  • Non-Refundable Fees: You expressly acknowledge that merchant processing fees, PayPal transaction fees, and administrative charges incurred during the booking process are strictly non-refundable in the event of cancellation or refund under any circumstance.
  • Currency Conversion: Your financial institution or PayPal may apply foreign exchange conversion rates and transaction fees to your account. MPY TOURS is not responsible for discrepancies between the pricing displayed on our platform and the final amounts deducted by your bank or payment processor.
  1. MPY TOURS as an Intermediary & Supplier Policies
  • Agency Role: MPY TOURS acts strictly and solely as an intermediary broker between the traveler and third-party service providers (including, but not limited to, airlines, hotels, tour operators, cruise lines, and vehicle rental companies).
  • Supplier Terms Prevail: Each third-party supplier governs its own inventory, rules, and restrictions. The specific terms and conditions of the final service provider apply to your booking and may supersede MPY TOURS’ terms if they are more restrictive. MPY TOURS is not liable for service changes, schedule modifications, or operational defaults enforced by suppliers.
  1. Integration of Cancellation, Refund & No-Show Policies

All cancellation requests, refund claims, and no-show events are governed strictly by the official MPY TOURS Cancellation, Refund & No-Show Policies Document, which is fully incorporated into this Agreement. Key conditions include:

  • Written Requirement Only: All cancellation or modification requests must be submitted in writing to our official email channel (mpytourssrl@gmail.com). Telephone or voice call cancellations are completely invalid and will not be processed.
  • Penalty Schedule: Cancellations are subject to progressive administrative forfeitures based on the date of receipt:
    • More than 60 days prior to departure: Minimum 10% penalty.
    • 45–59 days prior: Up to 25% penalty.
    • 30–44 days prior: Up to 40% penalty.
    • 15–29 days prior: Up to 60% penalty.
    • 7–14 days prior: Up to 80% penalty.
    • Less than 7 days prior to departure: 100% non-refundable.
  • No-Show Outcomes: Failure to appear at designated times, pick-up points, hotel check-ins, or flight segments constitutes a No-Show. A No-Show results in a 100% penalty and immediate forfeiture of the service value without a right to compensation.
  • Refund Timelines: Once a refund is formally authorized by the underlying suppliers, processing and execution back to the original PayPal or credit card payment instrument can take between 30 and 90 business days.
  1. Standards of Living, Special Conditions, and Pregnant Women
  • Destination Conditions: Standards of living, medical infrastructure, utilities (water and electricity supply), safety levels, and public services vary widely across international destinations. MPY TOURS is not responsible for illnesses, vector-borne insects, environmental conditions, or inconveniences inherent to tropical climates or local destination infrastructure.
  • Special Needs: Clients requiring special accommodations (e.g., wheelchair accessibility, medical assistance) must notify the MPY TOURS Service Center at least ten (10) business days prior to departure. Special requests are subject to third-party supplier availability and cannot be unilaterally guaranteed by the agency.
  • Pregnancy Policies: While normal pregnancies without complications are accepted on standard transportation assets, MPY TOURS does not permit pregnant women to participate in any excursions or high-risk tours sold on our platform. Clients who misrepresent their condition agree to indemnify MPY TOURS, its executives, and its suppliers against any medical liability, claims, losses, injuries, or legal expenses arising from participation in such activities.
  1. Protection of Minors and Family Logistics
  • Age Definitions: Infants are defined as passengers aged 0 to 23 months; children are defined as individuals aged 2 to 11 years and 23 months at the start of the service.
  • Documentation: For excursions and transport segments booked under a child rate, a valid birth certificate or passport must be presented upon arrival. If the minor’s age violates the child policy thresholds, the client must immediately pay the adult rate difference to secure the service.
  • Child Exploitation Prevention: MPY TOURS enforces a strict zero-tolerance policy regarding the exploitation of minors within the tourism sector. Minors are prohibited from boarding transport units or accessing accommodations without being accompanied by a verified parent or legal guardian. Any suspicious behavior will be reported immediately to law enforcement authorities.
  1. Intellectual Property & Software Licenses
  • Proprietary Rights: All website contents, including text, source codes, HTML, images, audio, branding, custom graphics, maps, and proprietary software, are the exclusive intellectual property of MPY TOURS, SRL. Any unauthorized copying, distribution, modification, reverse engineering, or commercial exploitation is strictly prohibited and subject to severe civil and criminal penalties.
  • Third-Party Sites: Our platform may display hyperlinks to external platforms or review systems. MPY TOURS does not endorse, control, or assume liability for content, safety parameters, or transactional actions executed on third-party websites.
  1. Limitation of Liability & Force Majeure
  • Disclaimer of Warranties: MPY TOURS does not guarantee the complete accuracy of product descriptions, imagery, pricing matrices, or real-time hotel ratings provided by third-party suppliers. We reserve the right to correct obvious pricing errors or systemic glitches and reject reservations made under incorrect values.
  • Force Majeure Events: MPY TOURS is legally discharged from any performance obligations, financial liabilities, or compensatory damages resulting from events beyond our reasonable control. This includes, but is not limited to: natural disasters, hurricanes, earthquakes, tropical storms, pandemics, epidemics, public health mandates, border closures, visa denials, civil unrest, strikes, airline insolvencies, or sudden government restrictions.
  • Baggage and Personal Belongings: The agency accepts zero liability for lost, stolen, delayed, or damaged luggage, personal items, or electronic equipment during transport, excursions, or hotel stays. The purchase of comprehensive travel insurance is strongly recommended to all clients.
  1. Legal Jurisdiction, Limitation Period, and Fraudulent Chargebacks
  • Governing Law: This Agreement, its execution, and any legal disputes arising from your interaction with our platforms or services shall be governed exclusively by the laws of the registered legal domicile of MPY TOURS, SRL (Dominican Republic).
  • Limitation of Action: You expressly agree that any legal claim, lawsuit, or judicial action arising out of or related to your use of this Website or services purchased through MPY TOURS must be initiated within twelve (12) months from the scheduled date of travel. Failure to bring a claim within this one-year period constitutes an absolute and irrevocable waiver of your right to sue.
  • Fraudulent Chargebacks: Initiating unauthorized, malicious, or fraudulent chargeback claims through PayPal or your credit card company for rendered services, valid no-shows, or standard cancellation penalties constitutes a breach of contract. MPY TOURS reserves the right to present emails, IP logs, digital checkboxes, and transaction invoices to payment processors as evidence, and to pursue aggressive legal debt recovery procedures against the client.
